These Terms explain the rules that apply when you browse ByteSIM, place an order, use the ByteSIM App, install an eSIM, or access a ByteSIM connectivity service.

Scope and acceptance

These Terms of Use (the “Terms”) apply to the ByteSIM website, online store, mobile applications, eSIM products, account functions, customer support channels, and related services operated by ByteSim Limited (“ByteSIM,” “we,” “us,” or “our”).

By accessing or using our services, creating an account, placing an order, installing or activating an eSIM, or otherwise using a ByteSIM product, you agree to these Terms and any product-specific conditions shown before purchase. If you do not agree, do not purchase or use the relevant service.

If a product page or written commercial agreement contains specific terms that conflict with these general Terms, the product-specific terms or written agreement will control only for that product or transaction.

Eligibility and information

You must be at least 18 years old, or the age of legal majority where you live, to enter into a purchase contract with ByteSIM. A parent, guardian, employer, travel agency, reseller, or other authorized purchaser may buy a service for another user and is responsible for providing these Terms and relevant product instructions to that user.

You agree to provide accurate, current, and complete order, account, billing, device, activation, and contact information. You are responsible for checking your email address, selected destination, plan, activation date, device compatibility, network-lock status, and other order details before payment.

You are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account, except where unauthorized activity results from ByteSIM’s failure to use reasonable security measures.

Services and plan information

ByteSIM offers prepaid eSIM connectivity and related digital services. Depending on the product, a plan may provide mobile data, calls, text messages, a telephone number, hotspot or tethering capability, access to one or more local networks, or other features expressly stated on the product page.

Plan features vary. Before purchasing, review the product page for:

  • countries and regions covered;
  • supported networks and available network generations, such as 4G or 5G;
  • data allowance, daily allowance, unlimited-data conditions, and any fair-use or speed-management rules;
  • service validity, activation method, activation date, and the time zone or measurement method used for service days;
  • availability of calls, text messages, local numbers, hotspot use, or app-based installation;
  • identity verification, IMEI, EID, device, operating-system, or other technical requirements.

References to “unlimited” data mean that no fixed total data allowance is stated for the applicable period, but the product may still be subject to the local carrier’s fair-use policy, daily high-speed allowance, traffic management, temporary speed reduction, or other conditions disclosed on the product page.

The product page and order confirmation are the primary sources for the features included in your specific plan.

Orders and contract formation

Submitting an order is an offer to purchase the selected service. A contract is formed when ByteSIM accepts the order and sends an order confirmation, makes the eSIM available in the ByteSIM App, delivers activation information, or begins provisioning the service, whichever occurs first.

We may decline, cancel, or request additional verification for an order where payment is not authorized, product information or pricing is clearly incorrect, the service is unavailable, legal or regulatory requirements apply, or fraud, abuse, resale, or unauthorized activity is reasonably suspected.

Electronic records, including order confirmations, account records, activation records, support communications, and transaction information, may be used to evidence the contract and use of the service.

Prices, taxes, and payment

Prices, currencies, discounts, and any applicable taxes or fees are shown at checkout. The currency charged may depend on your selected storefront, location, payment method, or checkout settings. Your card issuer, bank, or payment provider may apply exchange-rate differences, cross-border fees, or other charges that are not controlled by ByteSIM.

Payments are processed by the payment methods and third-party payment providers available at checkout. You authorize ByteSIM and the relevant provider to process the amount shown for your order and to perform reasonable fraud, authorization, and compliance checks.

Promotional codes, store credits, referral rewards, and other offers:

  • must be used according to their stated conditions and validity period;
  • may not be combined unless expressly allowed;
  • have no cash value and may not be transferred or resold unless expressly stated;
  • may be cancelled or withheld where obtained through error, misuse, fraud, or a violation of these Terms.

ByteSIM store credit is generally non-refundable and cannot be exchanged for cash, except where required by applicable law or expressly stated in the relevant offer.

Delivery, installation, and activation

ByteSIM services are delivered digitally. Most eSIMs are made available within minutes after an order is confirmed. Every eligible order can be accessed in the ByteSIM App, and QR-code eSIMs are generally also sent to the email address used for the order. Some products use scheduled delivery, app-based installation, manual provisioning, identity verification, or direct device push and may not include a QR code.

You are responsible for:

  • using a compatible, carrier-unlocked device that supports eSIM;
  • following the installation and activation instructions;
  • providing any required IMEI, EID, identity, activation date, or device information accurately;
  • installing and activating the eSIM at the recommended time;
  • keeping the eSIM and activation information secure and not sharing it with unauthorized persons.

An eSIM profile may be limited to one device or one installation. Deleting, transferring, resetting, or replacing a device may make reinstallation impossible. Do not delete an eSIM until the service has ended unless ByteSIM support instructs you to do so.

Service validity begins according to the activation rule shown on the product page. Depending on the plan, validity may begin upon installation, first network connection, a selected date, provider provisioning, or another disclosed event. A service day may be measured as a rolling 24-hour period or as a calendar day in a specified time zone.

Network availability and fair use

Mobile connectivity is provided through third-party telecommunications operators, roaming partners, and eSIM provisioning providers. Coverage maps, network names, estimated speeds, and network-generation references are indicative and may change.

Actual availability, quality, and speed depend on factors outside ByteSIM’s full control, including location, buildings, terrain, congestion, device model, supported bands, operating system, local regulation, carrier maintenance, weather, outages, roaming arrangements, and network management.

Carriers may apply fair-use policies, traffic management, temporary speed reductions, network prioritization, restrictions on abnormal usage, or suspension where use is excessive, automated, fraudulent, unlawful, harmful to the network, or materially affects other users. ByteSIM may take reasonable steps required by a carrier to protect the service and network.

5G, hotspot use, calls, text messages, local numbers, and access to particular networks are available only where specifically included and may also depend on local coverage, device support, and carrier policy.

Customer responsibilities

You must use ByteSIM services lawfully, reasonably, and only for their intended purpose. You must not:

  • use the service for fraud, harassment, abuse, illegal activity, unauthorized access, spam, malicious software, or infringement of another person’s rights;
  • interfere with, damage, overload, bypass, probe, or disrupt any network, system, account, security measure, or service;
  • share, duplicate, resell, commercially exploit, or transfer an eSIM, account, activation code, telephone number, store credit, or plan without authorization;
  • use automated systems or unusual traffic patterns in a way that harms the network or other users;
  • provide false information, misuse promotions, initiate fraudulent payments or chargebacks, or attempt to obtain services without payment;
  • reverse engineer, decompile, copy, modify, or create derivative works from the ByteSIM App, website, software, or proprietary systems except where applicable law expressly permits it.

You remain responsible for the content, communications, and activity transmitted through your device and service.

Refunds, cancellations, changes, and credits

Refunds, cancellations, replacements, order changes, and service credits are governed by the ByteSIM Refunds Policy in effect when your request is made, together with any product-specific conditions and mandatory consumer law.

Because an eSIM is a digital product that may be provisioned, delivered, installed, or activated shortly after purchase, cancellation rights may be affected once digital fulfilment or service performance has begun. This does not limit any refund or remedy available under the Refunds Policy or applicable law.

For connection problems, contact ByteSIM support as soon as reasonably possible and provide the requested order, device, setting, location, screenshot, or diagnostic information. We may first attempt troubleshooting, network switching, reprovisioning, replacement, or another reasonable solution before determining the appropriate refund.

No physical return is required for an eSIM. Approved refunds are normally issued to the original payment method or, where agreed, as ByteSIM store credit. Processing time may depend on the payment provider, bank, currency, and local holidays.

Third-party networks, apps, and services

ByteSIM relies on independent telecommunications operators, roaming partners, payment providers, app stores, device manufacturers, ecommerce platforms, identity-verification providers, and other service providers. Their terms, technical requirements, coverage, privacy practices, and availability may also apply.

Unless a product page expressly states otherwise, ByteSIM does not guarantee that a telephone number or eSIM can receive verification codes, one-time passwords, banking messages, short-code messages, emergency alerts, or registration messages from any specific third-party application or service. Third parties may block or restrict virtual, roaming, non-resident, or travel numbers independently of ByteSIM.

Links to third-party websites or services are provided for convenience. ByteSIM does not control and is not responsible for their content, security, availability, or practices.

Intellectual property

The ByteSIM name, logos, website, applications, text, graphics, interface, software, databases, product presentation, and other materials are owned by or licensed to ByteSIM and are protected by applicable intellectual-property laws.

ByteSIM grants you a limited, personal, revocable, non-exclusive, non-transferable right to use the website, App, and purchased services for lawful personal or internal business travel purposes in accordance with these Terms.

No ownership rights are transferred to you. You may not reproduce, distribute, sell, license, scrape, modify, publish, or commercially exploit ByteSIM materials without prior written permission, except where applicable law allows it.

Suspension and termination

ByteSIM may refuse, restrict, suspend, or terminate an account, order, eSIM, telephone number, credit balance, promotion, or service where reasonably necessary to:

  • respond to fraud, payment reversal, abuse, unauthorized resale, security threats, or unlawful activity;
  • protect users, networks, providers, ByteSIM, or third parties from harm;
  • comply with a carrier requirement, court order, law, regulation, sanctions rule, or government request;
  • address a material or repeated breach of these Terms;
  • manage a discontinued, unavailable, or technically unsupported service.

Where reasonably practicable and legally permitted, we will provide notice and an opportunity to resolve the issue. Refund eligibility following suspension or termination will depend on the reason, usage, applicable policy, and mandatory law.

Disclaimers and limitation of liability

ByteSIM will provide the services with reasonable care and skill. However, mobile and internet services cannot be guaranteed to be uninterrupted, error-free, available in every location, compatible with every device or third-party service, or delivered at a particular speed.

To the fullest extent permitted by applicable law, ByteSIM is not liable for:

  • coverage gaps, congestion, carrier outages, maintenance, network changes, device limitations, local restrictions, or other matters outside ByteSIM’s reasonable control;
  • losses caused by incorrect order information, incompatible or locked devices, failure to follow instructions, deletion of an eSIM, or unauthorized sharing of activation information;
  • indirect, incidental, special, punitive, or consequential losses, including loss of profit, revenue, opportunity, business, bookings, data, goodwill, or anticipated savings;
  • the cost of alternative connectivity, roaming charges, replacement devices, missed transport, accommodation, or other third-party expenses, except where expressly approved by ByteSIM or required by law;
  • events beyond reasonable control, including natural disasters, extreme weather, power failures, cyberattacks, war, terrorism, civil disorder, government action, telecommunications failure, or widespread internet disruption.

Where ByteSIM is liable and applicable law permits a limitation, ByteSIM’s total liability arising from the affected service will not exceed the amount you paid ByteSIM for that service.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence, or any other liability or consumer remedy that cannot legally be excluded or limited.

Privacy and communications

ByteSIM processes personal information as described in the ByteSIM Privacy Policy. Depending on the service, information may be shared with payment providers, ecommerce platforms, eSIM provisioning providers, telecommunications operators, roaming partners, customer-support providers, analytics providers, and other parties reasonably necessary to provide and protect the service.

Transactional and service communications, such as order confirmations, eSIM delivery, activation information, security notices, network updates, refund information, and support replies, are necessary to perform the service. Marketing communications are handled separately and may be unsubscribed from using the method provided in the message or the Privacy Policy.

Changes to services and these Terms

ByteSIM may update its products, networks, providers, prices, features, applications, policies, or these Terms to reflect operational, technical, commercial, security, legal, or regulatory changes.

The updated Terms will be posted on this page with a revised “Last updated” date. Material changes will apply prospectively unless a change is required immediately by law, regulation, security needs, or a service provider. Terms applicable to an already-purchased service will not be changed retroactively in a way that unlawfully reduces your rights.

Governing law and jurisdiction

These Terms and any non-contractual obligations arising from them are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles.

The courts of Hong Kong will have non-exclusive jurisdiction over disputes arising from these Terms. If you are a consumer, this clause does not prevent you from relying on mandatory consumer protections or bringing a claim in another court where applicable law gives you that right.

Before starting formal proceedings, you and ByteSIM agree to make a reasonable effort to resolve the dispute through customer support.

General provisions

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.

A delay or failure by ByteSIM to enforce a right does not waive that right. Any waiver must be clear and apply only to the specific circumstances for which it is given.

These Terms, together with the applicable product page, order confirmation, Refunds Policy, Privacy Policy, and any written product-specific conditions, form the agreement between you and ByteSIM regarding the purchased service.

Headings and summaries are provided for readability and do not change the meaning of the substantive provisions.
